RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

(“Agreement”)

In consideration of being permitted to be present at, attend, observe, or participate in activities offered or organized by Elite Juniors LLC. (“Elite Juniors”), I, for myself and for my minor child(ren) (collectively referred to as “I,” “me,” or “my”), and on behalf of my personal representatives, heirs, assigns, and next of kin, hereby agree as follows:

1. Acknowledgment of Risk and Responsibility

I acknowledge that I understand the nature of the activities offered by Elite Juniors (the “Activities”), and that I am qualified, in good health, and in proper physical condition to participate in such Activities. I agree that if at any time I believe conditions to be unsafe, or if I experience any decline in my physical or mental health, I will immediately discontinue participation and, if appropriate, leave the premises.

2. Authorization for Emergency Medical Care

I authorize Elite Juniors and its respective owners, investors, members, managers, shareholders, officers, directors, employees, volunteers, contractors, agents, landowners, subsidiaries, and affiliated companies (collectively, the “Releasees”), as well as any medical care providers, to provide or secure emergency medical care or transportation for me or my child, as they deem necessary in their sole discretion. I agree to be solely and fully responsible for any and all costs associated with such care or transportation.

3. Assumption of Risk

I understand and acknowledge that participation in the Activities involves certain inherent and other risks, including but not limited to serious personal injury, illness, emotional distress, permanent disability, and death, as well as property loss or damage. These risks may result from my own actions or inactions, the actions or inactions of others (including participants, spectators, or staff), the conditions in which the Activities occur, or the alleged or actual negligence of the Releasees.

I understand that the list of risks described in this Agreement is not exhaustive. There may be other risks, known or unknown, foreseeable or unforeseeable, inherent or otherwise, associated with the Activities. With full awareness and understanding, I VOLUNTARILY ASSUME ALL SUCH RISKS AND FULL RESPONSIBILITY FOR ANY INJURY, LOSS, OR DAMAGE I OR MY CHILD MAY SUSTAIN in connection with the Activities.

4. Waiver, Release, and Covenant Not to Sue

I hereby RELEASE, DISCHARGE, WAIVE, AND AGREE NOT TO SUE Elite Juniors, its officers, directors, employees, coaches, contractors, agents, volunteers, and all other personnel and the other Releasees from any and all liability, claims, demands, losses, causes of action, or damages of any kind, including those arising from or related to injury, illness, emotional distress, or death, even if caused in whole or in part by the alleged or actual negligence of the Releasees.

5. Indemnification

I agree to DEFEND, INDEMNIFY, AND HOLD HARMLESS each of the Releasees from and against any and all claims, causes of action, liabilities, damages, costs, and expenses (including attorneys’ fees) arising out of or related to my or my child’s participation in the Activities, including any claim brought by me or on my behalf, or by or on behalf of a minor child, despite this Agreement.

6. Scope and Enforceability

I agree that this Agreement applies each time I or my child are on the premises of Elite Juniors or participating in its Activities. This Agreement shall be binding upon me and my heirs, legal representatives, successors, and assigns. I further agree that this Agreement is intended to be as broad and inclusive as permitted by applicable law, and that if any portion of it is held to be invalid or unenforceable, the remaining provisions shall continue in full legal force and effect.

7. Acknowledgment

I HAVE CAREFULLY READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND AGREE TO BE LEGALLY BOUND BY IT. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT, INCLUDING THE RIGHT TO SUE. I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY, WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE.

8. Minor Release (if applicable)

If I am signing on behalf of a minor participant, I represent and warrant that I am the minor’s parent or legal guardian and have full authority to execute this Agreement on the minor’s behalf. I agree that the minor is subject to and bound by all terms of this Agreement. I further agree to DEFEND, INDEMNIFY, AND HOLD HARMLESS the Releasees from any and all claims brought by or on behalf of the minor, or anyone acting on their behalf, arising out of the minor’s presence at Elite Juniors or participation in the Activities.

I hereby grant the Elite Juniors permission to use my child's likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, and social media without payment or other consideration.
